Compose a Demand Letter

A demand letter is used as a negotiating tool with the insurance company of the person who caused your injury. You will list your injuries, who was responsible for them, your medical treatment, its cost, how much time and money you missed from work, and any other damages you have encountered. You will also state the reason why you qualify to make a claim against this person. In addition, you will list the amount of money you want to settle your suit.

Decide on a Settlement Figure

You will need to determine how much money you believe will be needed to deal with your injuries. You will need to decide on the minimum amount you want before speaking to the insurer. Do not mention your bottom-line figure to the insurer. This amount will come into play if you want to counter-offer their initial figure.

Keep in mind it is rare to get the exact amount you have requested. This is why you will need to inflate your initial figure so that you will ultimately get something close to what you want. If the first offer you receive is too low, you will need to go through the process of counter-offering until you reach an agreement.

Put It in Writing

After you have gone through all of these steps, you will need to make sure the entire agreement is in writing. You will need to send a formal letter to the insurance adjuster that lists all of the negotiations, the agreed settlement figure, what the damages were that will be remedied by the settlement, and the date on which you intend to get the money from the insurer.
